2. DETAILS OF OUR INFORMATION AND DEPUTY INFORMATION OFFICERS

3. DATA PROTECTION PRINCIPLES AND LEGAL BASIS OF THE PROCESSING
We comply with the Protection of Personal Information Act. This makes the following necessary - in relation to the personal data we have stored about you:

  • Lawful and transparent processing in good faith.
  • Collection and processing only for specified, clear and legitimate purposes.
  • Reasonable and substantial for the purposes specified by us and limited to what is necessary.
  • Factually correct and up to date.
  • Storage only for as long as necessary for the purposes stated by us.
  • Secure storage.

We process your personal data in accordance with the following legal basis for processing:

  •  Section 11(1)(a) of POPIA, if you give us your express consent to process personal data for specific purposes, in which case, consent can be revoked at any time, with effect for the future by contacting our information officer;
  • Section 11(1)(b) of POPIA, for the initiation, performance, or termination of our contractual relationship with you; or
  • Section 11(1)(c) of POPIA, for compliance with our legal obligations; or
  • Section 11(1)(d) of POPIA, in order to protect vital interests, or
  • Section 11(1)(e) of POPIA, for the performance carried out in the public interest, or
  • Section 11(1)(f) of POPIA, based on our (or a third party’s) legitimate interest, or Pursuant to Section 15 of POPIA, we may further process the personal data you have already provided as part of our supplier agreement, insofar as this is necessary for the initiation, performance, or termination of the relationship or for the exercise or fulfillment of the rights and obligations.

4. CATEGORIES OF PERSONAL DATA
We only process such data that is related to your interaction on the website. We will collect, store, and use the following categories of personal information about you:

  • Personal contact details such as:
  • Name, title, addresses,
  • Telephone numbers, and
  • Email addresses.

5. SOURCES OF DATA
We collect personal information about you through our cookies and/or information supplied. Where you provide us with Data about someone other than yourself and entity, you must obtain their consent before doing so.

6. USE OF DATA
Most commonly, we will use your personal information in the following circumstances:

  • Where we need to perform the contract we have entered into with you.
  • Where we need to comply with a legal obligation.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. We may also use your personal information in the following situations, which are likely to be rare:
  • Where we need to protect your interests (or someone else’s interests).
  • Where it is needed in the public interest (or for official purposes).

Situations in which we will use your personal information
We need all the categories of information in the list above to allow us to perform our contract with you and/or to pursue legitimate interests of our own or those of third parties, provided your interests and fundamental rights do not override those interests. The situations in which we will process your personal information are:

  • Product preferences,
  • Strategic planning,
  • Education, training and development requirements,
  • To conduct data analytics, and
  • To comply with applicable laws.

Some of the above grounds for processing will overlap and there may be several grounds which justify our use of your personal information.

Change of purpose
We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

7. DATA SHARING
Within our Company, we only pass on your personal data to those areas and persons who require this data to fulfil contractual and legal obligations or to fulfill our legitimate interests. This includes a transfer of your personal data to other TuppAfrica entities and other companies affiliated with us, as far as legally permissible within the framework of data protection. 

Your personal data may be processed on our behalf on the basis of commissioned processing contracts in accordance with Section 20 of POPIA. In these cases, we ensure that the processing of personal data is carried out in accordance with the provisions of POPIA. The categories of recipients in this case are providers of IT service, analysts, and administration.

All our third-party service providers and other entities in the group are required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.

We will share your personal information with other entities in our group as part of feedback, learning and planning, in the context of a business improvement or reorganization.

We may share your personal information with other third parties, for example in the context of the possible sale or restructuring of the business. In this situation we will, so far as possible, share anonymized data with the other parties before the transaction is completed. Once the transaction is completed, we will share your personal data with the other parties if and to the extent required under the terms of the transaction. 

We may also need to share your personal information with a regulator or to otherwise comply with the law.

8. TRANSFER TO A THIRD COUNTRY
We may transfer the personal information we collect about you within Asia and in some cases, we may transfer the personal information we collect about you to the United States of America in order to perform because we have a legitimate interest. The transfer of your data to these countries conforms to Chapter 9, Section 72 of POPIA. These countries are deemed to provide an adequate level of protection for your personal information.

To ensure that your personal information does receive an adequate level of protection, we have put in place appropriate measures, including contractual clauses to ensure that your personal information is treated by those third parties in a way that is consistent with and which respects POPIA on data protection.

9. DATA SECURITY
We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions, and they are subject to a duty of confidentiality. 

We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

10. DATA RETENTION
We process your personal data for as long as necessary for the establishment, performance or analysis,
relating to our agreement objectives. In some circumstances we may anonymize your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you.

11. YOUR RIGHTS AS DATA SUBJECT
If you want to review, verify, correct or request erasure of your personal information, object to the processing of your personal data, or request that we transfer a copy of your personal information to another party, please contact your HR Business partner or your Information Officer in writing.

Every data subject has the right within POPIA, under certain circumstances to:

  • Section 5(b) - Request access to your personal information (commonly known as a “data subject
    access request”). This enables you to receive a copy of the personal information we hold about you
    and to check that we are lawfully processing it.
  • Section 5(c) - Request correction of personal information that we hold about you. This enables you to
    have any incomplete or inaccurate information we hold about you corrected.
  • Section 5(c) - Request deletion of your personal information. This enables you to ask us to delete or
    remove personal information where there is no legitimate reason for us continuing to process it. You
    also have the right to ask us to delete or remove your personal information where you have exercised
    your right to object to processing (see below).
  • Section 5(e) - Object to processing of your personal information where we are relying on a legitimate
    interest (or those of a third party) and there is something about your particular situation which makes
    you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes.
  • Section 14(6) - Request the restriction of processing of your personal information. This enables you to
    ask us to suspend the processing of personal information about you, for example if you want us to
    establish its accuracy or the reason for processing it.
  • Section 14(6)(d) - Request the transfer of your personal information to another party.

If the processing of data is based on your consent, you are entitled to revoke your consent to the use of your personal data at any time in accordance with section 11 of POPIA. To withdraw your consent, please contact the Information Officer. Please note that the revocation is only effective for the future. Processing that took place before the revocation is not affected. Please also note that we may have to store certain data for a certain period of time in order to comply with legal requirements.

Insofar as the processing of your personal data pursuant to Section 11 of POPIA is carried out toprotect legitimate interests, you have the right pursuant to Section 11(3)(a) of POPIA to object to the processing of such data at any time for reasons arising from your particular situation. We will then no longer process this personal data unless we can prove compelling reasons for processing worthy of protection. These reasons must outweigh your interests, rights and freedoms, or the processing must serve the assertion, exercise or defense of legal claims.

In addition, you have the right of appeal to the Information Regulator pursuant to Section 18(1)(h)(v) of POPIA if you believe that the processing of your personal data is not lawful:

Your duty to inform us of changes
It is important that the personal information we hold about you is accurate and current. Please keep us
informed if your personal information changes during your working relationship with us.

12. CHANGES TO THIS PRIVACY NOTICE
We reserve the right to update this privacy notice at any time, and we will provide you with a new privacy
notice when we make any substantial updates. We may also notify you in other ways from time to time
about the processing of your personal information.
